GISLens Report Terms and Conditions

These terms cover Phase 1 free property reports and Phase 2 paid GIS reports provided by Mike Young, operating as GISLens, including their maps, exhibits, findings and related explanations.

Purpose of the service: GISLens helps identify mapped conditions, potential constraints and questions for further investigation. Reports support preliminary property decisions. They do not establish that a property is suitable, buildable, permitted or free of constraints.

1. Agreement and scope

You agree to these terms by actively accepting them on a GISLens request or order form, or through another documented acceptance process. Merely viewing this page does not constitute acceptance. If you act for an organization, you confirm that you are authorized to accept on its behalf.

The written scope accepted for your request identifies the property, selected topics, deliverables, price and any agreed timing. A specific provision in that scope controls if it conflicts with these general terms.

2. Phase 1 free property report

The free report reviews available property information to identify potential issues and recommend topics for further GIS analysis. Its coverage depends on the property, your stated decision and available data. It is an initial screening and does not investigate every possible issue.

Recommendations do not mean that an adverse condition has been confirmed. A topic that is not recommended may still matter. Receiving a free report does not obligate you to purchase further services. GISLens confirms whether it can accept a request and any estimated delivery timing.

3. Phase 2 paid GIS report

A paid report investigates the topics agreed for your property and includes the specified GIS exhibits and written findings. You may select recommended topics, other available standard topics, or separately scoped custom work. Unselected topics are outside the scope unless expressly included.

Fees relate to the agreed analysis and deliverables, not to finding a particular result. A finding that no relevant feature appears in the checked mapping is still a screening result. Exhibit count does not necessarily equal billable topic count.

4. Fees, changes and cancellations

The accepted quote or order sets the fees, payment schedule, deliverables, clarification allowance and any cancellation or refund terms. GISLens will obtain your agreement before performing work that adds charges or materially changes the scope.

If you request cancellation and no separate cancellation terms were agreed, charges are limited to work already performed and nonrecoverable costs you authorized, up to the agreed fee. Any unused prepaid balance will be refunded. Rights and remedies required by law remain available.

5. Public data, mapping and AI limitations

GISLens may use public records, third-party datasets, automated tools and artificial intelligence to assist research, analysis and report preparation. These sources and tools can contain omissions, outdated information, positional errors or incorrect interpretations. AI use does not remove GISLens's responsibility to exercise reasonable care within the agreed scope.

Findings reflect the sources and dates identified in the report. Map boundaries, distances and acreages are approximate unless expressly stated otherwise. The absence of a mapped feature does not establish that the condition is absent on the ground. Different layers may overlap and cannot simply be added to calculate a total constrained or usable area.

GISLens does not guarantee complete or error-free source information, identification of every constraint, or a particular property or regulatory outcome. There is no ongoing monitoring or update service unless agreed.

6. Independent verification

Reports do not replace boundary or title surveys, legal advice, engineering, geotechnical investigations, wetland delineations, biological surveys, appraisals or agency determinations. Published zoning and planning labels do not establish current development rights, approval effectiveness or compliance with approval conditions.

USDA NRCS soil information is screening-level information, not a site-specific soil, geotechnical, engineering, geological, septic-suitability or regulatory determination. Septic screening does not establish system approval, design or placement.

Before purchasing, financing, designing, clearing, building or seeking permits, obtain the professional and agency confirmations appropriate to your decision. You remain responsible for your decisions and for arranging verification beyond the agreed GIS screening scope.

7. Information you provide

Provide accurate parcel identification, your intended decision and relevant documents you are entitled to share. Notify GISLens promptly if these change. An incorrect parcel, incomplete instructions or missing records can affect the findings and may require a revised scope.

Provide only information needed for the screening. Do not submit passwords, financial account details or sensitive personal information. A report request does not authorize GISLens to apply for permits or make formal agency submissions on your behalf; those actions require separate authorization.

8. Use and sharing

You may use the delivered report for the stated property decision and share the complete report with your professional advisers. Keep its source notes, dates and limitations with any shared exhibits. Do not alter findings or present preliminary results as official approvals or verified field conditions.

The report is prepared for the requester and stated purpose. Sharing does not create a separate engagement with another recipient or extend the agreed scope. Another party seeking a report for its own reliance should arrange a separate written scope with GISLens. Third-party source materials remain subject to their applicable rights and use restrictions.

9. Errors and corrections

If you identify a possible error, contact GISLens with the report date, property and affected finding or exhibit. GISLens will review the concern and correct confirmed errors in its work without an additional correction fee. New data, changed conditions or additional questions may require separately agreed work. This correction process does not waive other remedies available under applicable law.

10. Limits on liability

To the extent permitted by applicable law, GISLens will not be liable for indirect, incidental, special or consequential damages arising from the services, including lost profits or lost business opportunities to the extent they qualify as such damages.

This limitation does not exclude or limit liability for fraud, willful misconduct, gross negligence, or liability that cannot lawfully be excluded or limited. It does not eliminate responsibility for every mistake or prevent a person from bringing a claim. No term overrides mandatory consumer protections or other nonwaivable rights.

11. Applicable law and changes

These terms are governed by North Carolina law, subject to mandatory laws that apply to the transaction. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

The version you accepted applies to that request or order. Later website changes do not retroactively change your agreement. Material changes to an existing engagement require agreement by both parties.
